NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
WINNER WILL BE REQUIRED TO RESPOND TO WINNER NOTIFICATION AND OTHER COMMUNICATIONS FROM FORBIDDEN BIKE CO (DEFINED BELOW) WITHIN ONE (1) WEEK ACCORDING TO THE NOTICE(S) FROM FORBIDDEN BIKE CO OR PRIZE MAY BE FORFEITED (IN FORBIDDEN BIKE CO’s SOLE DISCRETION).
A VALID EMAIL ADDRESS, FIRST NAME, LAST NAME, COUNTRY OF RESIDENCE, AND INTERNET ACCESS ARE REQUIRED FOR ENTRY.
BY ENTERING THIS SWEEPSTAKES, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO FORBIDDEN BIKE CO (DEFINED BELOW) FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.
The 2023 FORBIDDEN DREADNOUGHT SWEEPSTAKES (“Sweepstakes”) is sponsored by Forbidden Bike Co. By participating in the sweepstakes, each entrant agrees to abide by the instructions of Forbidden Bike Co. and these Official Rules, including, without limitation, all eligibility requirements, and understands and agrees that the results of the sweepstakes, as determined by Forbidden Bike Co. and its parent company, subsidiaries, affiliates, third-party prize suppliers, advertising/promotion agencies, and any entity involved in the production, implementation, administration, or fulfillment of the sweepstakes (collectively, the “Sweepstakes Parties”), and all decisions of the sweepstakes Parties are final and binding in all respects. The sweepstakes is void where prohibited by law. Any questions, comments, or complaints regarding the sweepstakes should be directed to Forbidden Bike Co.
1) SWEEPSTAKES PERIOD
The sweepstakes begins on October 27, 2023, at 9:00:00 AM PST and ends on November 17, 2023, at 11:59:59 PM PST (the “Sweepstakes Period”). All entries must be received during the sweepstakes Period as further set forth in the How to Enter section of these Official Rules.
2) ELIGIBILITY CRITERIA
The sweepstakes is open to legal residents of the 50 US states and the District of Columbia, Australia, New Zealand, the United Kingdom, or Canada who have reached the age of majority or older. Entrants who have already signed up for Forbidden Bike Co. mailing list and have a customer account at Forbidden Bike Co. platform (“Platform”) will also be eligible to win the prize – along with all other eligible individuals. The sweepstakes Parties have the right to verify the eligibility of each entrant. Employees, officers, directors, members, managers, agents, and representatives of the sweepstakes Parties, as well as their immediate family or persons living in the same household, are not eligible to enter this sweepstakes.
3) HOW TO ENTER
To participate in the sweepstakes, eligible individuals are required to enter by subscribing to the Forbidden Bike Co. email list through the designated sign-up form located at oneupcomponents.com/pages/2023-win-a-full–oneup-build-kit. The entry process necessitates the provision of essential details, including the participant’s email address, first name, last name, and country of residence.
It is imperative to note that a subscription to the email list serves as a free method of entry, and participants are not obligated to make any purchases for eligibility. Additionally, individuals who are already subscribers are not automatically entered into the contest and must enter into the contest via the aforementioned form.
4) PRIZE AWARD PROCESS
Entries that comply with the Official Rules and all instructions of Forbidden Bike Co. and are received during the sweepstakes Period (“Eligible Entries”) will be gathered into a database. On November 7, 2023, at the offices of Forbidden Bike Co., one (1) eligible entries will be selected by random computer-generated draw from among all Eligible Entries. The odds of winning depend on the number of Eligible Entries.
5) PRIZE NOTIFICATION AND DELIVERY
The selected entrant will be notified via email within 48 hours of the draw; email will be the primary method of notification. The selected entrant is required to acknowledge receipt of the notification of eligibility for the prize and to arrange for a mutually convenient day and time to complete the time-limited mathematical skill-testing question.
If no response is obtained from the selected entrant within ten (10) business days of the initial notification, the prize(s) will be forfeited. In such a case, an alternate winner(s) will be randomly selected by a computer from the remaining eligible entries. This process will continue iteratively until a selected winner or alternate winner(s) responds within the stipulated ten (10) business days.
Prize(s) will be delivered by mail within sixty (60) days of confirmation, verification of eligibility, and receipt of a signed waiver. In Canada, delivery is contingent on correctly answering the mathematical skill-testing question.
6) PRIZES AND APPROXIMATE RETAIL VALUE
The Prize consists of one Forbidden Bike Co. Dreadnought Frame kit with an approximate retail value (“ARV”) of the prize is $3,599 USD. However, Forbidden Bike Co. reserves the right to adjust the prize value to comply with local laws or regulations based on the winner’s residence. The actual prize value may be subject to slight variations depending on the applicable legal requirements in the winner’s jurisdiction.
ALL FEDERAL, NATIONAL, STATE, PROVINCIAL, TERRITORIAL, AND LOCAL TAXES AND IMPORT FEES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE SOLELY THE RESPONSIBILITY OF THE WINNER. Prize, if legitimately claimed, will be awarded. Prize details not specifically stated in these Official Rules will be determined in Forbidden Bike Co.’s sole discretion. Forbidden Bike Co. is not responsible for and will not replace any lost, mutilated, or stolen Prize or any Prize that is undeliverable or does not reach the winner because of incorrect or changed contact information. Forbidden Bike Co. is not responsible for any inability of the winner to accept or use the Prize (or portion thereof) for any reason. Forbidden Bike Co. reserves the right to substitute the stated Prize or portion thereof with another prize or portion thereof of equal or greater value for any reason, including, without limitation, Prize unavailability. No more than the stated Prize will be awarded.
7) ADDITIONAL LIMITATIONS/RULES
The Prize shall be accepted as is and may not be exchanged or refunded for an amount of money, sold or transferred, except in Forbidden Bike Co.’s sole discretion. No substitutions will be allowed, except in Forbidden Bike Co.’s sole discretion. The winner agrees that the sweepstakes Parties do not make any representations, warranties, or guarantees, express or implied, in fact or in law, whether now known or hereinafter enacted, relative to the use or enjoyment of the Prize, including, without limitation, its quality, condition, fitness for a particular purpose, or merchantability. The Sweepstakes Parties are not responsible for any typographical or other errors or omissions in the offer or administration of the sweepstakes, including, but not limited to, errors or omissions in any printing or posting of these Official Rules or other sweepstakes-related material, the selection and announcement of any winner, or the distribution of the Prize. Any attempt to deliberately damage any website or to undermine the legitimate operation of the sweepstakes is a violation of criminal and civil laws. Should such an attempt be made, the sweepstakes Parties reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. The sweepstakes Parties reserve the right to terminate, suspend or amend the sweepstakes, without notice, and for any reason, including, without limitation if the sweepstakes Parties determine that the sweepstakes cannot be conducted as planned or if a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond the sweepstakes Parties’ control corrupts the security or proper administration of the sweepstakes. In such event, Forbidden Bike Co. may award the Prize from Eligible Entries received prior to termination, amendment, or suspension or as otherwise deemed fair and appropriate by Forbidden Bike Co.. In the event of improper play, tampering or unauthorized intervention in the sweepstakes, the sweepstakes Parties reserve the right to void any suspect entries. Entrants agree to not damage or cause interruption of the sweepstakes and/or prevent others from using the sweepstakes. Forbidden Bike Co. reserves the right to restrict or void online entries or participation from any IP address if any suspicious entry and/or participation are detected. If Forbidden Bike Co. determines at any time in its sole discretion that a winner or potential winner is disqualified, ineligible, in violation of these Official Rules, or engaging in behavior that Forbidden Bike Co. deems obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Forbidden Bike Co. reserves the right to disqualify the winner or potential winner, even if the disqualified winner or potential winner may have been notified or displayed or announced anywhere. If any person supplies false information, obtains entries by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize, Forbidden Bike Co. may disqualify that person and seek damages from him or her and that person may be prosecuted to the full extent of the law. Released Parties are not responsible for any changes to or unavailability of the Platform that may interfere with the sweepstakes (including any limitations, any restrictions, or any conditions on Forbidden Bike Co.’s ability to use the Platform for the sweepstakes as set forth herein that are not acceptable to Forbidden Bike Co.) or ability of entrant to timely enter, receive notices or communicate with Forbidden Bike Co., in which case Forbidden Bike Co., in its sole discretion, may terminate or modify the sweepstakes. sweepstakes Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s e-mail or other account to receive messages. sweepstakes Parties are not responsible, and may disqualify you, if your e-mail address or other contact information does not work or is changed without prior written notice to Forbidden Bike Co.
8) INDEMNIFICATION AND LIMITATION OF LIABILITY
The sweepstakes Parties and each of their respective officers, directors, employees, members, managers, representatives, agents, successors and assigns (collectively, the “Released Parties”) will not be liable for any loss, damages or injury, claims or fees (including, without limitation, any injury, damage, death, loss, or accident to person or property) related to or arising out of: (a) preparing for, participating in and/or traveling to or from any prize- or sweepstakes-related activity; (b) any failure of the Released Parties’ websites or Platform during the sweepstakes; (c) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (d) fraudulent calls or emails made to entrants or any other persons; (e) any communication or mailings, or the acceptance, possession, use or enjoyment of any Prize; and (f) any events beyond the Released Parties’ control. By entering, each entrant agrees to comply with, and be bound by, these Official Rules, and agrees to indemnify, release and hold harmless Released Parties from any and all liability, whether caused by negligence, and claims, demands, losses, damages, costs and expenses arising out of or relating to an entrant’s participation in this sweepstakes, a winner’s acceptance or use of a Prize or any other liability with respect to this sweepstakes. sweepstakes Parties and Released Parties are not responsible for any typographical or other errors in the offer or administration of this sweepstakes, including but not limited to errors in the advertising, Official Rules, selection and announcement of the winner and distribution of the Prize. Each Prize winner acknowledges that the Released Parties have neither made, nor are in any manner responsible or liable for, any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Prize or regarding the use, value, or enjoyment of the Prize, including, without limitation, its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a Prize (if any) are subject to the respective manufacturers’ terms therefor, and Winners agree to look solely to such manufacturers for any such warranty and/or guarantee.
9) PERSONAL INFORMATION
Information collected for this sweepstakes will be treated in accordance with Forbidden Bike Co. privacy policy. The privacy policy can be found at https://forbiddenbike.com/policies-legal/privacy-policy/. Entrants expressly authorize Forbidden Bike Co. to obtain and deliver the personal information provided for the purpose of administering the sweepstakes and complying with applicable laws.
10) DISPUTE RESOLUTION AND GOVERNING LAW
Any disputes arising out of or connected with this sweepstakes shall be resolved individually, without resort to any form of class action, and exclusively by binding arbitration in the Province of British Columbia, Canada, pursuant to the then current commercial rules of the Arbitration and Mediation Institute of British Columbia. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this sweepstakes, but in no event attorney’s fees. These Official Rules shall be governed by, and construed in accordance with, the laws of the Province of British Columbia, Canada, without giving effect to any choice of law or conflict of law rules (whether of the Province of British Columbia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of British Columbia. Each entrant hereby irrevocably submits to the exclusive jurisdiction of the state and federal courts sitting in the Province of British Columbia, Canada.
